Filing 91 OPINION AND OPINION: re: 65 MOTION for Summary Judgment. filed by Kathy Carmody, Warwick Valley Central School District, Chris Fox, Marijane Reinhard. It is undoubtedly true that the plaintiff has a sympathetic case in view of her unquestioned med ical disability. On the other hand, the District granted the plaintiff a leave of absence and accommodated her wishes by transferring her and providing her with a new supervisor after she returned from her medical leave. Ultimately, the District was faced with the significant long-term decision, that is, whether to grant the plaintiff tenure despite her documented history of performance problems. Under all the circumstances, no reasonable jury could find that the denial of tenure, as well as the other actions about which the plaintiff complains, were tainted by discrimination or retaliation. The Court has considered all of the arguments of the parties. To the extent not specifically addressed above, the remaining arguments are either moot or without merit. For the foregoing reasons, the defendant's motion for summary judgment is granted. The Clerk is directed to enter Judgment and to close this case and all pending motions. (Signed by Judge John G.
