Filing 17 MEMORANDUM OPINION AND ORDER: For the foregoing reasons, defendants' motion for summary judgment 11 is granted. In addition, the claims against "M. Rose" are dismissed pursuant to Rule 12(b)(5). In light of Johnson's failure to participate in these legal proceedings and his flight from the jurisdiction, this dismissal is granted with prejudice.
