Filing 46 OPINION AND ORDER re:#100064 32 MOTION for Summary Judgment. Defendants' motion for summary judgment is GRANTED in its entirety. The Clerk of the Court is instructed to close the matter and remove it from my docket. filed by The Mount Sinai Hospital, The Mount Sinai School of Medicine, The Mount Sinai Medical Center, Dennis S. Charney, M.D. (Signed by Judge Harold Baer on 3/22/11) (djc) Modified on 3/23/2011 (jab). |
Filing 28 OPINION AND ORDER. For the reasons in this opinion and order Defendants' allegedly defamatory statements are either outside the applicable statute of limitations or protected by qualified immunity, and Plaintiff's defamation claim is dismis sed. The other tort claims, including injurious falsehood/trade libel, tortious interference with contract, tortious interference with prospective business advantage, and prima facie tort, are duplicative of the defamation claim and in any case Plain tiff has failed to allege sufficient factual content to sustain them. Those claims are likewise dismissed. The Mount Sinai Entities remain defendants, and Plaintiff may proceed on his sixth through eleventh causes of action, which have not been challenged in this motion. The Clerk of the Court is instructed to close this motion and remove it from my docket. (Signed by Judge Harold Baer on 12/17/10) (rjm) |
