OPINION AND ORDER: For the reasons set forth within, Vargas will be assigned counsel and provided an evidentiary hearing with respect to the claim that his counsel failed to adequately advise him concerning any plea agreements. There is no need for a hearing on the remaining issues as they lack merit. Lastly, petitioners motion to amend the petition (Docket #221 in 05 Cr. 1327) is granted.
