ORDER: CONCLUSION: For the foregoing reasons, Defendants' motion to dismiss is GRANTED with respect to Plaintiffs' federal claims. With respect to Plaintiffs' state law claims, Defendants' motion is deferred subject to renewal of the motion upon completion of limited, expedited discovery as to the membership of the Defendant LLCs and LPs. The Clerk of Court is directed to close the motion at docket number 10. In addition, Plaintiff is directed to properly file its Amended C omplaint, dated June 29, 2010, with the Clerk of Court. The Clerk of Court is directed to accept the Amended Complaint for filing as of August 25, 2010, the date a Courtesy Copy was received in Chambers.(Signed by Judge Paul A.
