OPINION & ORDER: Santiago's claims pursuant to 42 U.S.C. § 1983 are dismissed with prejudice. His claim for battery under New York law is dismissed without prejudice. Santiago's motion for leave to further amend his complaint is denied as futile. The Clerk of Court is directed to terminate this motion, docket number 33, the pending motion for appointment of pro bono counsel, docket number 46, and to close this case. (Signed by Judge Paul A.
