July 11, 2017 Opinion or Order Filing 118 FIRST FINAL ORDER OF FORFEITURE: NOW, THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED THAT: Pursuant to Title 21, United States Code, Section 853(n)(7) the United States of America shall and is hereby deemed to have clear title to the Specific Property. The United States Marshals Service shall take possession of the Specific Property and dispose of the same according to law, in accordance with Title 21, United States Code, Section 853(h), including possession of the 79th Street Property to effectuate sale of the 79th Street Property if the conditions precedent to such possession pursuant to paragraph 10 of the Order of Forfeiture are satisfied; Within 30 days of entry of this First Final Order of Forfeiture as to the Specific Property, the Government shall direct Fidelity Investments to cause $1,250,000 to be transmitted from the Fidelity Account (i.e. Fidelity Joint Investment Account No. Z72 715786) to the Trustee through wire transfer instructions to be provided by a representative of the Trustee employed by Baker & Hostetler LLP. The defendant and the Potential Claimants shall authorize such transfers and complete any necessary authorizations. This transfer, and any liquidation of funds necessary to effect this transfer, shall be for the benefit of the Trustee and with the consent of the defendant and Potential Claimants. The Government's interest to the "Frisch lOLA Account Funds" and the "Capstone Funds" is hereby relinquished and may be released to Barbara Bonventre upon entry of this Order; The Clerk of the Court shall forward four certified copies of this Final Order of Forfeiture to Assistant United States Attorney Sarah K.
