Filing 27 OPINION & ORDER: For the foregoing reasons, the Court GRANTS with prejudice the Unions' motion to dismiss pursuant to Rule 12(b)(6) and DENIES Pilchman's request for leave to file a Third Amended Complaint. Because the Court dismisses both claims on Rule 12(b)(6) grounds, it need not address the Unions' motion to dismiss pursuant to Rule 12(b)(7). The Clerk of Court is directed to close this case. Any pending motions are moot. (Signed by Judge Kimba M. Wood on 9/29/2011) (rdz) |
