Filing 50 OPINION AND ORDER. For the reasons in this Opinion and Order, the Court adopts Judge Smith's conclusion that the Amended Petition be denied but rejects the mootness analysis contained in the Report. Because the Amended Petition has been consider ed pursuant to 28 U.S.C. § 2241, the certificate of appealability requirement does not apply. See Drax v. Reno, 338 F.3d 98, 106 n.12 (2d Cir.2003).
