OPINION AND ORDER: We must view the facts in the light most favorable to the nonmovant. Thus, Plaintiffs' case may proceed under 12 NYCRR 23-1.7(e)(2) as a basis for his section 241(6) claim. Summary judgment is granted as to the section 241(6) claim based on section 23-1.7(e)(I) of the Industrial Code and as to the section 200 claim. SO ORDERED. (Signed by Judge Andrew L.
