MEMORANDUM OPINION AND ORDER. Defendants' motion for reconsideration is granted (doc. no. 222 in 09-2137). The September Order is vacated (doc. no. 129 in 09-2137, doc. no. 32 in 09-4414). New Plaintiffs' claims are dismissed in their entir ety as time-barred by the Section 13 statute of repose, insofar as they are asserted directly by New Plaintiffs as named parties. The dismissal of New Plaintiffs' claims is without prejudice to the litigation of those claims by one or more class representatives if MissPERS's pending motion for class certification is granted.
