For the foregoing reasons, the Court denies plaintiffs' motion to vacate the Clerk's Bill of Costs in i ts entirety but grants plaintiffs' motion as to the $148.50 in copying costs awarded to the defendants. The Court therefore grants costs to defendants in the amount of $6,272. The Clerk of Court is directed to terminate the motion pending at docket number 70. (Signed by Judge Paul A. January 24, 2013 Opinion or Order Filing 67 OPINION & ORDER re: #102840 31 MOTION for Summary Judgment on the Claims of Plaintiffs Jennifer Vuona and Catherine Wharton filed by Bank of America Corporation, Merrill Lynch, Pierce, Fenner & Smith, Incorporated, Merrill Lynch & Co., Inc., 33 MOTION for Summary Judgment on the Claims of Plaintiffs Sara Hudson and Julia Kuo filed by Bank of America Corporation, Merrill Lynch, Pierce, Fenner & Smith, Incorporated, Merrill Lynch & Co., Inc., 52 MOTION to Strike filed by Bank o f America Corporation, Merrill Lynch, Pierce, Fenner & Smith, Incorporated, Merrill Lynch & Co., Inc. For the foregoing reasons, ML's motion for summary judgment is granted as to Vuona, Wharton, Hudson, and Kuo's claims under Title VII and the NYSHRL. The Clerk of Court is directed to enter judgment in ML's favor as to those claims, to terminate the motions pending at docket numbers 31,33, and 52, and to close this case. Because the Court declines to exercise supplemental jurisdiction over the Plaintiffs' NYCHRL claims, they are dismissed without prejudice. (Signed by Judge Paul A. November 15, 2011 Opinion or Order Filing 19 OPINION AND ORDER: Plaintiffs' motion as to the first category of documents is granted in part and denied in part. Specifically, Merrill Lynch is directed to produce the following documents pertaining to the 30 non-RIF-eligible FA trainees at th e Fifth Avenue Branch during plaintiffs' tenure at Merrill Lynch from October 2006 through January 2009: (1) performance warnings, performance evaluations, and Performance Details reports; (2) separation documents for involuntary terminations; ( 3) teaming agreements; (4) Household Opportunity Reports; and (5) Length of Service rollback documents. Merrill Lynch need not produce hiring documents or leave of absence documents for these persons. Plaintiffs motion as to the second category of do cuments is also granted in part and denied in part. Specifically, Merrill Lynch is directed to produce complaints of gender discrimination from January 2006 forward as to any manager at the Fifth Avenue branch who at any point from March 2006 through Plaintiffs termination had supervisory or evaluative authority of any kind over one or more of the Plaintiffs. Merrill Lynch need not produce complaints about gender discrimination as to any other managers. Merrill Lynch is further directed to produ ce sworn testimony and statements which relate to the complaints of gender discrimination as to the three key decision-makers (Joseph Mattia, Joel Meshel, and Anna Roccanova).
