Filing 42 OPINION AND ORDERre: 29 MOTION to Dismiss. filed by Moody's Investor Sevice, Inc., Moody's Corporation, 31 MOTION to Dismiss. filed by Raymond McDaniel. For the foregoing reasons, Moody's and McDaniel's motions to dismiss Kolc hinsky's claims for defamation, tortious interference with business advantage, intentional infliction of emotional distress, and declaratory judgment are granted. These claims are dismissed with prejudice for failure to state a claim. The Second Amended Complaint has adequately alleged a violation of the anti-retaliation provision under Sarbanes-Oxley, 18 U.S.C. § l514A. The Clerk is directed to terminate these motions at Docket Nos. 29 and 31. The parties should meet and confer in the preparation of a Civil Case Management Plan.
