Filing 88 MEMORANDUM OPINION AND ORDER, that for that are set forth in this Opinion and Order, Unique's motion to dismiss is denied and Fiesta's motion to dismiss is granted. The Court previously gave Jovani the opportunity to amend its amended compl aint in response to the defendants' first motion to dismiss, and plainly stated that any dismissal would be with prejudice.
