December 7, 2011 Opinion or Order Filing 36 OPINION & ORDER re: 26 MOTION to Amend/Correct 2 Complaint. filed by Aaron Higgins. For the foregoing reasons, the Court denies plaintiffs motion for leave to amend the Complaint as to all claims except his claim of retaliation for the exercise of FMLA rights, based on the leave he took to tend to his daughter's hospitalization. See 29 U.S.C. § 2612(a)(1)(D). Defendant's cross-motion for sanctions is denied. Plaintiff is directed to file an amended Complaint consistent with this opinion by no later than December 14, 2011.
