Filing 33 OPINION AND ORDER:#101014 Defendant Credit Suisse's motion (Dkt. No. 26) to dismiss the amended complaint is granted in part and denied in part. The claims for tortious breach of insurance contract and declaratory relief are dismissed. Credit Suisse's motion is denied with respect to the claim for breach of contract. So ordered.
