Filing 51 MEMORANDUM OPINION AND ORDER re: 41 MOTION to Dismiss the Third Amended Complaint filed by Joseph Czerniawski, H. Brown, A. Johnson, Rhodes, Devastey, Kathleen Mulvey, M. Hernandez, S. Sampson. For the foregoing reasons, Defendants' motion to dismiss is GRANTED. The Clerk of Court is directed to mail a copy of this Memorandum Opinion and Order to Plaintiff and to close the case. The Court certifies, pursuant to 28 U.S.C. § 1915(a)(3), that any appeal from this order would not be taken in good faith; therefore, in forma pauperis status is denied for purposes of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). (Signed by Judge Jesse M. Furman on 7/12/2013) (lmb) |
