Filing 22 OPINION & ORDER re: 13 MOTION to Dismiss Plaintiff's Complaint, filed by New York City Department of Education. The Department of Education's March 21, 2011 motion to dismiss is granted in part. Jackson's claims against the De partment of Education for violations of her substantive due process rights under the Fifth and Fourteenth Amendments and for retaliation are dismissed. The Department of Education's motion to dismiss is denied with respect to Jackson's Title VII claim. The Department of Education has not moved with respect to Jackson's claim under the ADA; therefore this claim survives as well. (Signed by Judge Denise L. Cote on 7/7/2011) (ab) |
