REDACTED OPINION AND ORDER re: 106 Motion for Summary Judgment. Zurich contends that Lantheus's losses are not covered under the policy because (i) Lantheus did not experience a total cessation of business activity, and (ii) the shutdown was c aused in whole or in part by the excluded peril of corrosion. Zurich now moves for summary judgment on these two grounds. For the reasons discussed herein, Defendant's motion for summary judgment is GRANTED. OPINION AND ORDER re: 35 MOTION for Issuance of Letters Rogatory as to Atomic Energy of Canada, Limited in Canada filed by Lantheus Medical Imaging, Inc. For all of these reasons, Lantheus' motion for the issuance of amended letters rogatory is granted. In accordance with this Opinion, the Court shall issue the amended letters rogatory seeking the assistance of the Canadian courts in obtaining the production of the documents from AECL and in taking the deposition testimony upon oral exam ination of AECL as a witness in this action. Lantheus shall promptly submit for Court approval a proposed order and the appropriate forms of the amended letters rogatory that are consistent with this Opinion, and that also provide that Zurich will have the right to obtain copies of any documents that are produced and to participate in any discovery that is permitted by the Canadian courts.
