OPINION AND ORDER re: 173 CROSS MOTION for Summary Judgment . filed by Westchester County, Westchester County Department of Correction, 164 FIRST MOTION for Summary Judgment Notice of Motion. filed by Manuel Moses: Befor e the Court are Plaintiff's motion for summary judgment and the cross-motion of Defendants Westchester County Department of Correction ("DOC") and Westchester County ("County") (together, the "County Defendants") fo r summary judgment. For the foregoing reasons, the Court GRANTS the County Defendants' cross-motion for summary judgment and DENIES Plaintiff's motion for summary judgment, thus dismissing Plaintiff's sole remaining claim. OPINION AND ORDER re: 23 MOTION for Certificate of Appealability filed by Westchester County, Westchester County Department of Correction, 21 MOTION for Certificate of Appealability filed by Westchester County, Westchester County Department of Co rrection. For the foregoing reasons, County Defendants' motion for certification of an interlocutory appeal is DENIED. Moreover, as County Defendants' motion for certification is denied, the Court need not address County Defendants' motion for a stay pending interlocutory appeal, which is DENIED as moot.
