Filing 33 ORDER. In an Order dated July 15, 2011 Magistrate Judge Theodore H. Katz granted Plaintiff leave to amend the Complaint to drop, the John Doe Defendants. (See Docket #30.) No Amended Complaint has since been filed, nor is the Court aware of any efforts being made to identify the John Doe Defendants. ENDORSEMENT: Plaintiff seeks to amend the complaint to remove the John Doe Defendants as parties nunc pro tunc. Rule 15 of the Federal Rules provides that leave to amend should be fully given when justice so requires. Having relieved Defendants' letters, the Court perceives no bona fide substantive opposition to the motion. Certainly, the amendment will result in no prejudice to defendants. The primary reason defendants oppose the application is their concern that the amendment will trigger a pretrial conference and the possibility of pretrial discovery. That concern will be separately addressed at a conference. Accordingly, Plaintiff is granted leave to amend the Complaint to drop the John Doe Defendants nunc pro tunc.
