March 12, 2012 Opinion or Order Filing 52 MEMORANDUM OPINION AND ORDER re: #101553 #12 MOTION to Amend/Correct #11 Amended Complaint filed by Andrew J. Mayo. On August 18, 2011, Plaintiff filed a motion to amend the complaint to add new defendants, NYU Medical School and Mount Sinai Medical School. "In the ordinary course, the Federal Rules of Civil Procedure provide that courts 'should freely give leave' to amend a complaint 'when justice so requires.'" Fed.R.Civ.P. 15(a)(2); Williams v. Citigroup, Inc., 659 F.3d 208, 212 (2d Cir. 2011). A pro se litigant should generally be granted leave "when a liberal reading of the complaint gives any indication that a valid claim might be stated." Shomo v. City of N. Y., 579 F.3d 176, 183 (2d Cir. 2009). However, "leave to amend a complaint need not be granted when amendment would be futile." Ellis v. Chao, 336 F.3d 114, 127 (2d Cir. 2003). Plaintiff does not provide any facts that support his position that the proposed defendants have any nexus with the claims alleged in this case. While he states that both NYU and Mount Sinai "prepared, performed services that resulted in injury to my person," it is unclear what role, if any, the proposed defendants are alleged to have played with respect to Plaintiff's claims. Where Plaintiff "has provided no details beyond this naked assertion [of a wrongful act]," the court has cause to deny leave. December 29, 2011 Opinion or Order Filing 22 ORDER: On December 28, 2011, plaintiff, pro se, attempted to have default judgment entered in this matter. The judgment clerk refused to sign plaintiff's Clerk's Certificate because the Government's time to respond had not yet expired. The court now orders that plaintiff's attempted filing (ECF Docket No. 21) be returned to him, because all defendants have made timely appearances, as set forth more fully herein. The court recognizes that plaintiff is untutored in legal practice, and is suffering from health issues which make it difficult to manage his case. Nevertheless, plaintiff must stop repeatedly contacting chambers and the pro se office in this untimely pursuit of a default judgment. Repeated contacts to chambers or the pro se office in an attempt to enter untimely, vexatious, or frivolous filings can result in sanctions under FRCP 11. See Maduakolam v. Columbia University, 866 F.2d 53, 56 (2d Cir. 1989). The fact that plaintiff has appeared pro se "does not shield him from Rule 11 sanctions because one acting pro se has no license to harass others, clog the judicial machinery with meritless litigation, and abuse already overloaded court dockets."
