Filing 17 OPINION AND ORDER: The August 15, 2011 motion to dismiss is granted with respect to plaintiffs federal claims for violations of the RICO statute under 18 U.S.C. §§ 1962(c) and (d), for malicious prosecution and malicious abuse of process un der 42 U.S.C. § 1983 and state law, for violation of procedural due process under 42 U.S.C. § 1983, and for attorney's fees pursuant to 42 U.S.C. 1988.
