Filing 23 OPINION AND ORDER re: 15 MOTION to Dismiss the Complaint filed by G. Bauer, Inc., Irving Bauer. For the reasons above, the Bauer Entities' motion to dismiss is GRANTED IN PART and DENIED IN PART. Specifically, the Court grants the Bau er Entities' motion to dismiss Romag's abuse of process claims, but denies their motion to dismiss in all other respects. The clerk is directed to terminate the motion at Docket No. 15. The parties are directed to meet and confer and to pre pare a Civil Case Management Plan. The parties should submit the agreed upon plan in advance of the Civil Case Management Conference scheduled for Thursday, December 1, 2011, at 4:00 p.m., in Courtroom 20-C.
