Filing 18 OPINION AND ORDER re: 7 MOTION to Dismiss filed by Bloomberg LP, Andrew Lack. For the reasons set forth above, the motion of Defendants Bloomberg and Lack to dismiss for improper venue (Docket No.7) is GRANTED and Plaintiffs complaint as to thos e Defendants is dismissed in its entirety. In light of that ruling, the Court need not, and does not, reach Defendants' alternative argument that Plaintiffs state law claims should be dismissed. Plaintiff is hereby ORDERED to show cause in writ ing, no later than August 24, 2012, why the complaint should not also be dismissed against Henderson for the same reasons or, in the alternative, for failure to serve the complaint in a timely fashion. If the Court does not receive any such communication from the Plaintiff, the Court will dismiss the case altogether without further notice to either party. (Signed by Judge Jesse M. Furman on 8/10/2012) (mro) |
