AMENDED ORDER: The Court is in receipt of an ex-parte application from pro se Defendants Douglas R. Dollinger and Georgette Franzone dated November 10, 2011, requesting a stay of discovery in the above captioned case. The Court is informed, however, that a subpoena in the action has already been served by the Plaintiff on third parties, Glenn T. Hall and Katrina Hall, for the production of documents and depositions to be taken at Plaintiff's offices in New York, New York on November 14, 2011. The Court finds that it is premature to commence discovery and accordingly quashes the subpoena issued by Plaintiff Lask on November 2, 2011 to the Halls. Once Defendants are properly served, the Court will promptly schedule an initial conference and an orderly plan for discovery will be issued. (Signed by Judge Barbara S.
