September 26, 2012 Filing 107 FINDINGS OF FACT AND CONCLUSIONS OF LAW ON CIVIL CONTEMPT: Plaintiff Securities and Exchange Commission (the "SEC") moves for an order finding defendant John A Mattera ("John Mattera" or "Mattera") and relief defendant Ann A Mattera ("Ann Mattera") (referred to collectively as the "Mattera Defendants") in civil contempt. Specifically, the SEC asserts that John Mattera and Ann Mattera, who is John Mattera's mother, have disobeyed this Court's orders dated November 17, 2011, November 29, 2011, and December 1, 2011 (referred to collectively as the "Court's Orders"). Set forth below are the Court's Findings of Fact and Conclusions of Law. Having considered the parties' submissions and the evidence admitted into the record, the Court finds by clear and convincing evidence that the Mattera Defendants violated the Court's Orders. The Mattera Defendants are therefore adjudged to be in contempt of Court, and the SEC's motion is granted. Nothing in this Order shall vary, alter, or modify the terms of the TRO dated November 17, 2011 (Docket# 4), the Consent Order dated November 29, 2011 (Docket# 25), and the PI Order dated December 1, 2011 (Docket# 28), all of which remain in effect. As I understand it, these gifts may be used for business or personal expenses in which the money was used for only for exactly that. The loans in question total US$100,000.00 since December 2011.
