Filing 205 OPINION AND ORDER: For the foregoing reasons, the Court, by Order dated July 23, 2015, granted the Sonar Defendants' motion for summary judgment dismissing the Third Amended Complaint. In addition, because that ruling forecloses plaintiff' s fraudulent transfer and unjust enrichment claims, the Court now dismisses plaintiff's claims against the Investor Defendants as well. Accordingly, the Clerk of the Court is directed to enter final judgment dismissing the Third Amended Complaint in its entirety, with prejudice, and to close the case. (As further set forth in this Opinion and Order.) (Signed by Judge Jed S. Rakoff on 7/30/2015) (tro) |
Filing 76 OPINION AND ORDER: Based on the foregoing reasons, the Court on February 8, 2013 granted defendants' motions to dismiss the Complaint, without prejudice to repleading. The parties are instructed to jointly call Chambers by no later than June 18, 2013 to set a schedule for any further pleadings and proceedings.. (Signed by Judge Jed S. Rakoff on 6/12/2013) (js) |
