For the foregoing reasons, th e Union's Motion for Summary Judgment is GRANTED, and DHL's Motions for Partial Summary Judgment is GRANTED in part and DENIED in part. Plaintiff's Fourth, Fifteenth, Sixteenth and Seventeenth causes of action are dismissed. Because Plaintiff has no remaining claims against the Union, the Union is dismissed as a Defendant in this action. OPINION: Before the Court is Plaintiff Baez Romero's Motion to Compel the Production of Documents. (Docket No. 95.) In his motion, Baez Romero asks the Court to compel non-party Sedgewick Claims Management Services ("Sedgewick") to pr oduce documents in response to a subpoena Baez Romero served on Sedgewick. Following Sedgewick's representation to the Court at a telephone conference on December 16, 2013, that it will comply with the subpoena, this motion is DENIED as moot. This resolves Docket Number 95. Accordingly, there is no indication that Ayala's testimony would be relevant to Baez Romero's claims against DHL. Th erefore, Baez Romero's request to depose Ayala is DENIED.
