OPINION & ORDER re: 11 MOTION to Dismiss The Plaintiff's Declaratory Action. filed by Sean Gelb, 3 MOTION Enjoin Second-Filed Action in Florida Federal District Court. filed by 242 Partners, L.P., AXA Art Insurance Company. I have co nsidered the parties' remaining, arguments and find them to be without merit. For the reasons stated above, Plaintiffs' motion to enjoin the Florida action is DENIED. The Court further Orders that Plaintiffs' Declaratory Judgment Action is DISMISSED. The Clerk of Court is further instructed to close the motions And this case.
