No. 43, is GRANTED insofar as Plaintiffs' RESPA claim, pursuant to 12 U.S.C. § 1607(a), is dismissed for failure to state a claim, under Federal Rule of Civil Procedure 12(b)(6). The remainder of Defendants' Motion to Dismiss is DENIED. Status Conference set for 10/18/2013 at 11:45 AM in Courtroom 906, 40 Centre Street, New York, NY 10007 before Judge Alison J. Nathan.
