OPINION AND ORDER: re: 19 MOTION for Summary Judgment. filed by Alison Mattia. Because Plaintiff has not yet established any violation of the FLSA or the NYLL, I need not consider Plaintiff's argument that she is entitled to state and federal liquidated damages and prejudgment interest in the event she does establish liability. For the foregoing reasons, Plaintiff's motion for partial summary judgment is GRANTED in part and DENIED in part.
