October 13, 2015 Opinion or Order Filing 181 ORDER: In light of the foregoing, the Court hereby orders that the third party defendants' motion for sanctions and Mr. Chong's relevant taxation of costs are DISMISSED with PREJUDICE. The Court further orders that the settlement between third party defendants and Mr. Ly in the Bankruptcy Court shall remain entirely unaffected by the parties' settlement as to the sanctions issue in this action. The Court now considers the sanctions issue to be fully resolved and directs the Clerk of Court to terminate this action. However, if the parties believe that this Order does not fully resolve all outstanding issues, they shall inform the Court within 72 hours of the filing of this Order. The Court notes that it received a response from Mr. Chong that attached both his own preferred version of a form of order and Mr. Minsley's proposed form of order, which Mr. Minsley had submitted as an attachment to his September 22, 2015 letter addressed to Magistrate Judge Dolinger. September 23, 2015 Opinion or Order Filing 177 ORDER: After discussion with Magistrate Judge Dolinger's chambers, the Court understands that the parties have been unable to reach an agreement on language for a stipulation relating to third-party defendants' sanctions motion. Within seven days of the date of this Order, the parties shall submit to the Court their preferred versions of a proposed stipulation with consent of the parties for the Court to choose between the parties' submissions and enter a binding stipulation and order that will terminate this dispute. Alternatively, the Court will hold a hearing on the sanctions motion without any reference to the parties' proposed stipulations. The Court has been informed by the chambers of Magistrate Judge Dolinger that nothing further would be accomplished by continuation of the reference for settlement purposes. November 15, 2012 Opinion or Order Filing 24 ORDER: At the status conference of November 13, 2012, the Court sua sponte raised the question of its subject matter jurisdiction over this action should defendant fail to meet the $500,000 gross sales/business volume necessary to be considered an "[e]nterprise engaged in commerce or in the production of goods for commerce" under 29 U.S.C. 203(s). Having looked into the matter, the Court finds that subject matter jurisdiction is adequately alleged, and - at present - no Court order is warranted to require either limited discovery into that issue or an early motion for summary judgment on that issue. If any party believes both (1) that plaintiffs are not employees engaged in commerce or engaged in the production of goods for commerce, and (2) that plaintiffs are not employed in an enterprise so engaged, it should inform the Court of its position by letter.
