For the foregoing reasons, the Court adopts Magistrate Judge Gorenstein's recommendation that the case be dismissed a nd Etheridge's motion for leave to amend the complaint is denied. The Clerk of Court is directed to terminate the motions at docket numbers 13 and 18, enter judgment on behalf of AlliedBarton, and close this case.
