Filing 228 MEMORANDUM & ORDER denying 136 Motion to Certify Class; denying 136 Motion to Appoint Counsel ; denying 139 Motion to Certify Class. For the foregoing reasons, the Court finds that Plaintiff has failed to meet his burden of proving that &q uot;there are questions of law or fact common to the class" within the meaning of Rule 23(a)(2), and his motion for class certification under Rule 23 is accordingly denied. The Court further finds that Plaintiffs "renewed" motion for conditional certification is improper, and it is denied as well. As previously discussed, the parties shall submit a joint letter proposing a briefing schedule for a motion for decertification within one week of the date of this order. See Dkt. No. 214. Filing 220 ORDER granting 70 Motion to Compel Arbitration. For the foregoing reasons, the SCI Defendants' motion to dismiss and compel arbitration as to Plaintiff Kenneth Chow is granted with respect to Plaintiffs disputes against all defendants. Having decided to dismiss the case and compel arbitration, the Court need not reach the A-1 Defendant's request to "stay Plaintiffs action against A-1 pending the resolution of the arbitration of Plaintiffs claims against SCI."
