Filing 60 MEMORANDUM ORDER. Defendants' motion to dismiss the amended complaint is granted. Plaintiff Grammer's cross-motion to amend is also granted. Plaintiff must serve and file within 30 days of the entry of this order a second amended complaint substituting the Trustee as the plaintiff in this action, and incorporating the limitations imposed by this Memorandum Order. Defendants' previously-filed answer (docket entry no. 15) will be deemed a response thereto. If no timely second amende d complaint is filed, the dismissal of the amended complaint will be treated as one with prejudice as to the Trustee as well as with respect to Grammer's personal claims, and the case will be closed without further advance notice. This case rema ins referred to Magistrate Judge Francis for general pretrial management. This Memorandum Order resolves docket entry numbers 33 and 50.
