Filing 66 REPORT AND RECOMMENDATION re: 60 MOTION to Dismiss filed by Apple Inc. Plaintiff Andrea Peterson, proceeding pro se, brought this action pursuant to the Age Discrimination in Employment Act, Title VII of the Civil Rights Act of 1964, the New York State Human Rights Law, and the New York City Human Rights Law alleging that defendant Apple Inc. (Apple) refused to hire her on the basis of her age and negligently inflicted emotional distress. See Complaint, filed Aug. 23, 2012 (Docket # 1) (Compl .). Apple now moves to dismiss this action based on Peterson's failure to comply with Court orders and her failure to prosecute pursuant to Rules 37(b)(2) and 41(b) of the Federal Rules of Civil Procedure. Because Peterson has filed no oppositi on to the motion, and because the motion is meritorious for the reasons discussed below, Apples motion should be granted and the case should be dismissed with prejudice. Pursuant to 28 U.S.C. 636(b)(1) and Rule 72(b) of the Federal Rules of Civil Pr ocedure, the parties have fourteen (14) days including weekends and holidays from service of this Report and Recommendation to serve and file any objections. Such objections (and any responses to objections) shall be filed with the Clerk of the Cour t, with copies sent to the Hon. George B. Daniels, and to the undersigned, at 500 Pearl Street, New York, New York 10007. Any request for an extension of time to file objections must be directed to Judge Daniels. If a party fails to file timely objections, that party will not be permitted to raise any objections to this Report and Recommendation on appeal.
