OPINION & ORDER re: 139 MOTION to Dismiss In Part the Second Amended Complaint. filed by Sand Canyon Corporation, 128 MOTION for Reconsideration re; 124 Order on Motion for Leave to File Document, Defendant's Not ice of Motion for Reconsideration. filed by Sand Canyon Corporation: Before the Court are Defendant Sand Canyon Corporation's ("Defendant") motions (1) for reconsideration of the September 30, 2016 order granting Plaintiff Homewa rd Residential, Inc. ("Plaintiff") leave to file a second amended complaint and (2). to dismiss in part the Second Amended Complaint ("SAC"). For the reasons stated above, Defendant's motion for reconsideration is DENIED and Defendant's motion to dismiss in part the second amended complaint is DENIED in part and GRANTED in part only as to Plaintiff's claims for breach of MLPA § 3.01(a)(24), the "no-fraud" representation.
