OPINION & ORDER re: 41 MOTION to Dismiss Pursuant to Rule 12(b)(6). filed by John Caruso, JTC Painting and Decorating Corp. For the reasons stated above, the Court denies defendants' motion to dismiss. The Court will hold a conference to discuss the management of this case on Monday, October 28, 2013, at 5 p.m., in Courtroom 1305 of the Thurgood Marshall U.S. Courthouse, 40 Centre Street, New York, New York 10007.
