Filing 60 OPINION AND ORDER re: 31 MOTION to Dismiss Notice of Rule 12(b)(6) Motion to Dismiss filed by Service Employees Int'l Union Local 32BJ, 34 MOTION to Dismiss Notice of Motion filed by Quality Building Services. The Court has c onsidered all of the arguments by the parties. To the extent not specifically addressed above, the arguments are either moot or without merit. For the reasons explained above, the plaintiff has failed to state a claim that Local 32BJ breached its dut y of fair representation or that QBS breached the Collective Bargaining Agreement. Therefore, the defendants' motions to dismiss are granted. The Clerk is directed to enter judgment dismissing this action and closing the case.
