OPINION AND ORDER: Based on the foregoing, the Court finds that the Sale Agreement was not terminated pre- or post-petition. Accordingly, the Bankruptcy Court's decision denying Debtor's motion to dismiss and granting Magner's motion f or summary judgment is vacated and this case is remanded for further proceedings consistent with this opinion.
