Filing 17 OPINION AND ORDER: On September 30, 2013, the parties appeared before me for a settlement conference and reached an agreement to resolve the case. Upon review of the parties' pleadings and ex parte submissions and based on the confidential discu ssions with each side, I find that the settlement agreement was fair and reasonable. The plaintiff brought his case under the Fair Labor Standards Act ("FLSA"), 29 U.S.C. § 201 et seq., and the New York State Labor Law ("NYLL" ;). His complaint asserts generally that, during his employment at Senor Pollo, his employers failed to pay him minimum wages and overtime compensation, as required by the FLSA and NYLL... In light of the disputed facts raised in this case, I find th e approval of this settlement agreement to be a fair and reasonable resolution of this case... Accordingly, the case is DISMISSED with prejudice but without costs; provided, however, that within 30 days of the date of this Order, counsel for the plaintiff may apply by letter to restore this action to this Court's calendar, in which event the action will be restored.
