Filing 74 MEMORANDUM OPINION AND ORDER re: 36 FIRST MOTION for Summary Judgment, filed by The City of New York, James Lamur, Timothy Kraus, 39 MOTION for Partial Summary Judgment in favor of plaintiff on his state and federal claims for (i) denial of a fair trial, and (ii) malicious prosecution, filed by Ashique Soomro. The Defendants' motion for summary judgment is granted as to Plaintiff's federal and state law false arrest claims, and is denied in all other res pects. Plaintiff's motion for partial summary judgment is denied. Accordingly, Plaintiff's malicious prosecution and denial of fair trial claims will proceed as against Kraus and Lamur. The final pre-trial conference in this case will be he ld on May 23, 2016, at 4:30 p.m. (Docket entry no. 71.) The parties must confer and make submissions in advance of the conference as provided in the Pre-Trial Scheduling Order. (Docket entry no. 24.)
