IT IS HEREBY ORDERED, ADJUDGED, AND DECREED THAT judgment is entered in favor of Defendant Spanish Broadcasting System, Inc, against Plaintiffs Latin American Music Company, Inc., also known as LAMCO, and Asociacin de Compositores y Edi tores de Musica Latinoamericana, also known as ACEMLA, jointly and severally, in the amount of $448,532.13 for district court attorneys' fees, $41,317.26 for appellate court attorneys' fees, and $13,543.66 for costs, for a total award of $503,393.05. Judgment is also entered in favor of non-party indemnitor Broadcast Music, Inc., against Plaintiffs LAMCO and ACEMLA, jointly and severally, in the amount of $290,453.81 for district court attorneys' fees, $44,259.04 for appellate court attorneys' fees, and $6,935.05 for costs, for a total award of $341,647.90. June 1, 2020 Opinion or Order Filing 221 ORDER granting 215 Motion for Attorney Fees. Accordingly, IT IS HEREBY ORDERED THAT that Defendant's application for attorneys' fees is GRANTED. Defendant is awarded $824,562.24 in attorneys' fees: $448,532.13 for St roock's district court work; $41,317.26 for Stroock's appellate work; $290,453.81 for Hughes Hubbard's district court work; and $44,259.04 for Hughes Hubbard's appellate court work. Defendant is also awarded  6;13,543.66 in costs paid by Stroock and $6,935.05 in costs paid by Hughes Hubbard. February 6, 2017 Opinion or Order Filing 130 OPINION AND ORDER re: 114 MOTION for Partial Summary Judgment filed by Spanish Broadcasting System, Inc. For the reasons set forth above, IT IS HEREBY ORDERED THAT Defendant's motion for partial summary judgment is granted in part and denied in part. Specifically, Plaintiffs' infringement claims as to Abuelita, Aguanile, Ausencia, Mi Genie, Soy Sensacional, Mantecadito, and Arroz con Bacalao are dismissed; as to the remaining six songs for which i nfringement is alleged in the third amended complaint, Plaintiffs may only recover statutory damages for any infringement, and in all other respects, Defendant's motion is denied. The Clerk of the Court is respectfully directed to terminate t he motion pending at docket number 114. Pursuant to the parties' election in the October 13, 2015 case management plan and scheduling order, this case is to be tried by the Court. (Doc. No. 83.) IT IS FURTHER ORDERED THAT a bench trial in th is matter shall commence on Monday, April 17, 2017 at 9:30 a.m. in Courtroom 905 of the Thurgood Marshall United States Courthouse, 40 Foley Square, New York, New York. Trial shall begin with the testimony of Raul Bernard. The Court will set deadlines for pretrial submissions in a forthcoming order. (As further set forth in this Opinion and Order.)
