OPINION AND ORDER re: 123 MOTION to Strike Document No. 118 filed by Gina Diacomanolis, 94 MOTION for Summary Judgment filed by Gina Diacomanolis, 87 MOTION for Summary Judgment filed by Donald J. Le wittes, 106 MOTION for Summary Judgment filed by Joseph Sallustio, La Toya S. Griffin, John B. Mattingly, Cassandra Chandler, Bertha Stallings, City of New York: For the reasons stated above, Defendants' motions for summary judgment are GRANTED, and the Complaint is dismissed in its entirety. Further, Defendants' motion to strike is DENIED as moot to the extent that it seeks to strike Plaintiffs' submissions and GRANTED to the extent that it seeks sanction s. Within one week of the date of this Opinion and Order, Defendants' shall submit a joint statement listing the fees and costs incurred in bringing the motion to strike. Plaintiffs' counsel shall have one week from the date on which Def endants submit their statement in which to file any opposition to the fees and costs claimed therein. Plaintiffs' counsel is cautioned that the failure to timely file an opposition in conformity with the Court's rules will result in Defe ndants' submission being deemed unopposed. The Clerk of Court is directed to terminate Docket Nos. 87, 94, 106, and 123 and to close the case. The Court retains jurisdiction to adjudicate the amount that Plaintiffs' counsel has to pay in sanctions. (Signed by Judge Jesse M. Furman on 3/25/2015) (tn)

OPINION AND ORDER re: 27 AMENDED MOTION to Dismiss. AMENDED MOTION to Dismiss for Lack of Jurisdiction filed by Donald J. Lewittes. For the foregoing reasons, Lewittes's motion to dismiss is GRANTED in part and DENIED in part. All of Plaintif fs' federal law claims against Dr. Lewittes are dismissed, and all of Plaintiffs' state law claims against Dr. Lewittes are dismissed, with the exception of their malicious prosecution claim. Defendant Diacomanolis's cross-claims agai nst Dr. Lewittes for indemnification and contribution are also dismissed, except to the extent they seek contribution with respect to Plaintiffs' malicious prosecution claim.
