MEMORANDUM OPINION AND ORDER re: 48 MOTION for Summary Judgment filed by Reservoir Media Management Inc. Because defendants fail to raise any material facts in dispute, plaintiff's motion for summary judgment is GRANTED with respect t o defendants' liability for copyright infringement. Because the amount of statutory damages is an issue to be decided by a jury, plaintiff's motion for summary judgment with respect to damages is DENIED. For the reasons outlined above, pl aintiff's motion for summary judgment is GRANTED in part and DENIED in part. The Clerk of Court is directed to terminate the motion pending at Dkt. No. 48.
