For the foregoing reasons, the DOCCS Defendants' motions to dismiss the complaint are GRANTE D, and the City Defendants' motion to dismiss is GRANTED with respect to all of the City Defendants except for Deutsch. The motion is DENIED with respect to Tavares's claim against Deutsch based on Deutsch's alleged failure to protect his surgical wound.
