For the foregoing reasons, the Commissioner's March 19 decision is affirmed and Defendant's motion for judgment on the plea dings is GRANTED. The Court certifies, pursuant to 28 U.S.C. § 1915(a)(3), that any appeal from this Opinion and Order would not be taken in good faith; therefore, in forma pauperis status is denied for purposes of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of Court is directed to mail a copy of this Opinion and Order to Plaintiff, to terminate Docket Entry No. 22, and to mark the case closed. SO ORDERED.
