Filing 32 MEMORANDUM OPINION & ORDER re: 17 MOTION to Dismiss filed by RBS Securities Inc., Financial Asset Securities Corp. RBS Holdings USA Inc. For the reasons stated above, Defendants' motion to strike under Fed. R. Civ. P.12(f) is deni ed. Defendants' motion to dismiss is granted in part and denied in part, as set forth above. The Clerk of Court will terminate the motions (Dkt. No. 17). The Court will conduct a Rule 16 conference in this matter on April 30, 2015 at 11:00 a.m. in Courtroom 705 of the Thurgood Marshall United States Courthouse, 40 Foley Square, New York, New York, 10007.
