OPINION AND ORDER. Because "there is no genuine dispute as to any material fact" and Xchanging "is entitled to judgment as a matter of law," Fed. R. Civ. P. 56(a), defendants' motion for summary judgment dismissing plaintiff& #039;s amended complaint (Dkt. No. 53) is granted. The clerk will enter judgment accordingly, with each party to bear its own costs and disbursements.
